Accommodation Terms

Based on the model accommodation terms published by the Japan Tourism Agency (last revised 13 December 2023), adapted to how we operate. Identical to the booklet in your room.

Article 1 — Scope of Application

1. Accommodation contracts and related agreements between Foresta Hakone Onsen (the “Hotel”) and a guest are governed by these Terms and Conditions. Matters not provided for here are governed by applicable laws, regulations, and generally accepted practices.

2. A lawful special agreement takes precedence over these Terms. Specific conditions stated by a booking channel or accommodation plan also take precedence.

Article 2 — Application for Accommodation

1. An applicant must provide the guest name, accommodation date, estimated arrival time, number of guests, accommodation charge, contact details, meal information, and any other information reasonably required by the Hotel.

2. A request to extend a stay is treated as a new application when the request is made.

Article 3 — Conclusion of Contract and Deposit

1. The accommodation contract is concluded when the Hotel accepts the application and sends a booking confirmation. Receipt of a booking request alone does not conclude a contract, unless the Hotel cannot prove it did not accept the request.

2. After conclusion, the Hotel may request a deposit or advance payment up to the basic accommodation charge for the stay, limited to three days when the stay exceeds three days.

3. A deposit is applied first to accommodation charges, then cancellation charges, and then damages. Any balance is refunded. If a required deposit is not paid by the stated deadline and the Hotel gave notice of that consequence when setting the deadline, the contract becomes invalid.

Article 4 — Special Agreement Requiring No Deposit

The Hotel may agree that no deposit is required. If the Hotel neither requests a deposit nor sets a payment deadline, the Hotel is treated as having accepted this special agreement.

Article 4-2 — Cooperation with Infection-Control Measures

The Hotel may request cooperation with infection-control measures under Article 4-2, Paragraph 1 of the Hotel Business Act.

Article 5 — Refusal of an Accommodation Contract

1. The Hotel may refuse to conclude an accommodation contract only within the Hotel Business Act and other applicable law. This Article does not permit refusal for reasons outside the law.

(1) The application does not comply with these Terms. (2) The Hotel is fully booked. (3) The applicant is reasonably considered likely to violate law, public order, or good morals in connection with the stay.

(4) The applicant is reasonably considered to be an organized crime group, a member or associate, a related person or other antisocial force; an entity controlled by such persons; or a corporation with such a person among its officers.

(5) The applicant behaves in a manner that seriously disturbs other guests. (6) The applicant is a patient or other person covered by the specified infectious-disease provisions of the Hotel Business Act.

(7) A violent demand is made, or a burden beyond a reasonable range is demanded, except a request to remove social barriers under the Act on Elimination of Discrimination against Persons with Disabilities.

(8) The applicant repeatedly makes an excessively burdensome request specified by Article 5-6 of the Enforcement Regulations of the Hotel Business Act that may seriously impede services to other guests.

(9) Accommodation cannot be provided because of a natural disaster, facility failure, or another unavoidable cause.

(10) The case falls under Article 4 of the Kanagawa Prefecture Hotel Business Act Enforcement Ordinance, including serious disturbance caused by intoxication or markedly abnormal conduct, or serious nuisance caused by an extremely unsanitary body or clothing condition.

Article 5-2 — Explanation of Refusal

An applicant may ask the Hotel to explain its reason for refusing to conclude an accommodation contract under the preceding Article.

Article 6 — Guest’s Right to Cancel

1. A guest may cancel the accommodation contract by notifying the Hotel.

2. If the guest cancels all or part of the contract for a reason attributable to the guest, the cancellation charges in Attached Table 2 apply, but only if the Hotel gave advance notice of the obligation. Specific conditions shown by the booking channel or plan take precedence.

3. If the guest does not arrive by 20:00 without notice, or by two hours after a stated arrival time, the Hotel may treat the contract as cancelled by the guest.

Article 7 — Hotel’s Right to Cancel

1. Within applicable law, the Hotel may cancel the contract when the guest is reasonably considered likely to violate, or has violated, law, public order, or good morals; is an antisocial force; seriously disturbs other guests; is covered by the specified infectious-disease provisions; makes a violent or unreasonable demand; repeatedly makes a legally defined excessive request; cannot be accommodated because of force majeure; or falls under the applicable Kanagawa ordinance.

2. The Hotel may also cancel when the guest fails to follow fire-prevention rules, including the prohibitions on smoking in bed, using open flames, or tampering with fire-safety equipment.

3. When the Hotel cancels under this Article, it does not charge for services the guest has not yet received.

Article 7-2 — Explanation of Cancellation

A guest may ask the Hotel to explain its reason for cancelling an accommodation contract under the preceding Article.

Article 8 — Guest Registration

1. By the accommodation date, each guest must register name, address, contact information, and any other information required by the Hotel. A foreign guest without an address in Japan must also register nationality and passport number.

2. The Hotel may request presentation and retention of a copy of a passport or other identification where required by law or administrative guidance.

Article 9 — Guest-Room Occupancy Hours

1. A guest may use the room from 15:00 on the arrival date until 10:00 on the departure date. During a consecutive stay, the room may be used throughout the day except on arrival and departure dates.

2. Subject to availability and cleaning, the Hotel may permit use outside these hours. The extra charge is one-third of that day’s room charge for up to three hours, one-half for up to six hours, and the full room charge for more than six hours.

Article 10 — Observance of House Rules

Guests must follow the House Rules stated in this booklet and posted on the Hotel premises.

Article 11 — Service Hours

1. Check-in begins at 15:00; check-out is by 10:00. Private onsen hours are 16:00-23:00 and 6:00-9:00 the next morning; morning reservations are accepted until 8:00. Meal, front-desk, and other service hours are provided in the booking confirmation, guest app, posted notices, or daily information.

2. These hours may change temporarily for unavoidable reasons. The Hotel will provide notice by an appropriate method.

Article 12 — Payment of Charges

1. Charges are described in Attached Table 1. The accommodation charge is the amount confirmed in the reservation, subject to any special plan conditions.

2. Charges must be paid in Japanese yen or another method accepted by the Hotel at the time specified by the Hotel.

3. Accommodation charges remain payable if the room has been made available but the guest voluntarily chooses not to stay.

Article 13 — Liability of the Hotel

The Hotel compensates a guest, in accordance with applicable law, for damage caused by the Hotel in performing or failing to perform the accommodation contract or related agreements, except where the damage is not attributable to the Hotel.

Article 14 — When a Contracted Room Cannot Be Provided

1. With the guest’s consent, the Hotel will, where practicable, arrange other accommodation under equivalent conditions.

2. If other accommodation cannot be arranged, the Hotel pays compensation equivalent to the applicable cancellation charge, credited toward damages. No compensation is paid when the failure to provide the room is not attributable to the Hotel.

Article 15 — Valuables and Other Property

1. Use the in-room safe for cash and valuables. The Hotel does not normally accept cash or valuables for deposit. If staff expressly agree to receive an item and it is damaged, the Hotel will handle the matter under applicable law.

2. If property not deposited with the Hotel is damaged through the Hotel’s intent or negligence, the Hotel compensates the loss under applicable law.

Article 16 — Baggage and Lost Property

1. Baggage arriving before check-in is stored only when the Hotel has agreed in advance.

2. If lost property is found after check-out and the owner is known, the Hotel will seek instructions. If no instructions are received or the owner is unknown, the item is held for seven days including the discovery date and then delivered to the nearest police station. Food, drinks, or other unsafe or unsanitary items may be disposed of earlier under law and customary practice.

Article 17 — Parking

The Hotel provides a parking space but does not assume custody of the vehicle. If the Hotel causes damage intentionally or negligently, it compensates the loss under applicable law.

Article 18 — Guest Liability

A guest must compensate the Hotel for damage caused by the guest’s intent or negligence.

House Rules

House Rules

Set out under Article 10 of the accommodation terms, so that every guest can stay in comfort and safety.

1. Fire Safety

No smoking, open flames, candles, incense, fireworks, portable stoves, or tampering with alarms, exit signs, extinguishers, or other fire equipment.

2. Dangerous or Illegal Items

Do not bring flammable, explosive, strongly odorous, illegal, or otherwise dangerous items onto the property.

3. Registered Guests Only

Only registered guests may enter guest rooms. Tell staff in advance before changing the number of guests.

4. Quiet Hours

Quiet hours are 22:00-7:00. Keep voices, music, videos, movement, and door noise low in rooms, corridors, and shared areas.

5. Smoke-Free Property and Pets

The property is non-smoking. Pets are not allowed. Contact us in advance regarding assistance dogs.

6. Property and Equipment

Do not remove, relocate, or alter furniture or equipment. You may be charged for damage caused intentionally or negligently.

7. Keys and Access Codes

Lock your room and do not share keys, QR codes, safe codes, or companion codes. Report any loss or disclosure immediately.

8. Business and Recording

No unauthorized business, sales, solicitation, commercial filming, live streaming, or drone use. Respect the privacy of other guests and staff.

9. Conduct

Gambling, violence, threats, harassment, discriminatory conduct, excessive intoxication, and serious disturbance are prohibited.

10. Emergencies

Follow applicable law and instructions from public authorities, Hotel staff, announcements, and exit signs.
